Denpasar, 11/7 (Atnews) - The Supreme Court (MA) rejected the Application for Judicial Review against the Gubernatorial Regulation No.97/2018 concerning the Restriction of Disposable Plastic Waste.
The judicial review was put forward by the Indonesian Plastic Recycling Association (ADUPI), Didie Tjahjadi (businessman of plastic bag-based products) and Agus Hartono Budi Santoso (plastic product industry businessman).
To that end, the policy of Bali Governor restricting the generation of disposable plastic waste has a strong and legal position throughout Bali.
This was conveyed by Governor of Bali, Wayan Koster, when organizing a press conference for media crews on the victory of the Bali provincial government related to the application of judicial review against the Gubernatorial Regulation No.97/2018.
The assertion is meant to answer the accusation that Bali Gubernatorial Regulation No.97/2018 has made a new norm in the form of prohibition that is not set forth in the Law No.18/2008 concerning Waste Management, and the Bali Regional Regulation No.5/2011 concerning Waste Management is incorrect.
Since it is in harmony with the legal consideration of the Supreme Court, the norm of waste reduction stipulated in Law No. 18/2008 and Bali Provincial Regulation No.5/2011 concerning Waste Management must even be interpreted as prohibition against the use of disposable plastic.
As stipulated in the Bali Gubernatorial Regulation No.97/2018; thus, the policies issued by Governor of Bali are appropriate and correct.
With the decision of Supreme Court, all the parties must comply with and implement the entire contents of Bali Gubernatorial Regulation No. 97/2018 to maintain the sanctity and harmony of Bali along with its contents in accordance with the vision ‘Nangun Sat Kerthi Loka Bali’ through the Planned Universal Development Pattern heading for New Era of Bali.
“Similarly, other regions that want to implement this policy are not necessary to hesitate any longer,” he affirmed.
On that account, other regional governments throughout Indonesia need not hesitate and fear to make policy regulations to realize a clean, green and beautiful nature of Indonesia.
In addition, his party has prepared a waste management regulation so that it does not return to pile up in the Final Landfill (TPA).
On that occasion, he will invite observers that provide support and sympathy as well as defend the policies of Bali provincial government regarding restrictions against the generation of disposable plastic waste from the central government, environmental activists of various countries, and observers of public policy on the anniversary of Bali provincial government falling on August 14.
The activity is intended to give the highest appreciation and gratitude to all parties that have shown a commitment to the environmental preservation. (ART/02)
